Terms of Service

1. Acceptance of Terms

By accessing or using prompt-market.jp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Prohibited Content

• Prompts referencing real, identifiable individuals (including celebrities, voice actors, VTubers, and idols)
• Content depicting or implying minors in any sexual or inappropriate context
• NSFW / sexually explicit material — the Service is SFW only at this time
• Content that infringes on third-party intellectual property rights
• Hate speech, discrimination, or content promoting violence
• Any content that violates applicable laws or public morals

3. Intellectual Property

Creators warrant that they hold the necessary rights to any prompts they publish. The Service publishes prompt text itself; the copyright status of AI-generated images is governed by applicable law. Commercial use terms set by creators (personal / commercial / extended) define the license granted to users.

User License Scope

The license granted to users is the right to use published prompts to generate AI images and videos. The following acts are strictly prohibited:

• Selling or transferring prompt text for a fee
• Re-listing or publishing the prompt on other prompt marketplaces (Civitai, PromptBase, or any similar service)
• Redistributing a prompt with the creator attribution removed or altered
• Sublicensing — granting exclusive rights in the prompt to another person

Violations constitute copyright infringement against the original creator and a breach of these Terms. We will take action under Section 6.

4. Payments and Refunds

Prompts on the Service are free; no fee is charged for them. The only paid items are credits used for on-site image and video generation and monthly plans. All payments are processed through Stripe. Credits and monthly plans are non-refundable. If a generation fails due to a fault attributable to the Service, the credits spent are returned.

5. Creator Royalties

Each time another user generates on-site with a creator's prompt, the creator receives a royalty in credits (currently 5 credits). Royalty credits cannot be exchanged for money and can only be used for generation on the Service. We may change the royalty amount; changes are announced in these Terms or on the site.

6. Account Suspension and Termination

We may suspend or terminate accounts without prior notice if a user:

• Violates these Terms or applicable law
• Engages in fraudulent activity or abuses chargebacks
• Posts or lists prohibited content
• Resells or republishes published prompts on other platforms
• Otherwise acts in a manner we deem inappropriate

In addition to account termination, we reserve the right to forfeit any pending earnings or credit balances, and to pursue damages or other legal remedies as appropriate.

6-2. Account Deletion and Data Handling

You may request deletion of your account at any time from account settings. Deletion is handled as follows:

• A 30-day recovery period starts when you request deletion. Your profile, listings, generated images and characters are hidden but retained. If you sign in and cancel the deletion within this period, your account is restored as it was.
• After 30 days, your personal data (profile, generated images, characters and listings) is permanently deleted and cannot be recovered.
• As required by Japanese tax and bookkeeping law, transaction records (credits and plans) are retained in a form that does not identify you for 7 years and are used only for tax, refund/chargeback handling and fraud investigation.
• Any monthly plan is cancelled when deletion is requested. The current billing period is not refunded pro rata, and unused credits expire at the end of the recovery period.

7. Disclaimer

We make no warranties regarding the quality, accuracy, or fitness for purpose of any prompts available on the Service. You use the Service at your own risk. Our liability is limited to cases of intentional misconduct or gross negligence on our part.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the Fukuoka District Court as the court of first instance.
