Terms of Service

1. Acceptance of Terms

By accessing or using prompt-market.jp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Prohibited Content

• Prompts referencing real, identifiable individuals (including celebrities, voice actors, VTubers, and idols)
• Content depicting or implying minors in any sexual or inappropriate context
• NSFW / sexually explicit material — the Service is SFW only at this time
• Content that infringes on third-party intellectual property rights
• Hate speech, discrimination, or content promoting violence
• Any content that violates applicable laws or public morals

3. Intellectual Property

Creators warrant that they hold the necessary rights to any prompts they list. The Service sells prompt text itself; the copyright status of AI-generated images is governed by applicable law. Commercial use terms set by creators (personal / commercial / extended) define the license granted to buyers.

Buyer License Scope

The license granted to buyers is limited solely to using the purchased prompt to generate AI images. The following acts are strictly prohibited:

• Reselling, transferring, or redistributing purchased prompt text to any third party
• Re-listing or publishing the prompt on other platforms (Civitai, PromptBase, or any similar service)
• Publicly posting the full prompt text on social media, blogs, or any other medium
• Sublicensing — granting any rights in the prompt to another person

Violations constitute copyright infringement against the original creator and a breach of these Terms. We will take action under Section 6.

4. Payments and Refunds

All purchases are processed through Stripe. Prompt purchases are non-refundable once the prompt content has been revealed. Credit purchases are non-refundable. Exceptions may apply in cases of verified technical failure attributable to the Service.

5. Creator Payouts

Creators receive 75% of each prompt sale price via Stripe Connect. The platform retains 25% as a service fee covering payment processing, infrastructure, and moderation.

6. Account Suspension and Termination

We may suspend or terminate accounts without prior notice if a user:

• Violates these Terms or applicable law
• Engages in fraudulent activity or abuses chargebacks
• Posts or lists prohibited content
• Resells or republishes purchased prompts on other platforms
• Otherwise acts in a manner we deem inappropriate

In addition to account termination, we reserve the right to forfeit any pending earnings or credit balances, and to pursue damages or other legal remedies as appropriate.

7. Disclaimer

We make no warranties regarding the quality, accuracy, or fitness for purpose of any prompts available on the Service. You use the Service at your own risk. Our liability is limited to cases of intentional misconduct or gross negligence on our part.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the Fukuoka District Court as the court of first instance.
